International trademark registration.

To file an international application, an application must also be submitted for the same designation in the country of origin.

Currently, most countries have ratified the Protocol to the Madrid Agreement, giving the right at the application stage to begin the International trademark registration.

Today, there are 106 member countries of the World Intellectual Property Organization. In any of these countries, you can register your trademark with our help.

Get protection in any country is possible in 2 ways:

  • This is the filing of an application directly to the Patent Office of the country in which you want to receive protection;
  • filing an application for registration under the Madrid Agreement and its Protocol.

     Filing an application directly to the patent office of the country in which you want to receive protection is convenient (including financially) when it comes to 2-3 countries. If there are more countries, we advise you to submit an application under the Madrid Agreement and the Protocol of the Madrid Agreement. This is more attractive when the number of countries in which you want to get registration is more than 3. At the beginning of 2016, the Madrid Agreement was signed by 106 member countries. The countries that have signed the Madrid Agreement can be found on the website.

Example 1. You need to get protection for a sign for goods and services (up to 3 classes of ICGS) in all countries of the European Union. In this case, your expenses will be as follows:

state fee for filing an international application - 600.00 UAH;

The international filing fee to all countries of the European Union is CHF 1,565.00 (black and white trademark);

The international fee for filing an application to all countries of the European Union - CHF 1,815.00 (color trademark);

services for registration and filing of the international application - 2800.00 UAH.

Example 2. You need to get protection for a trademark (up to 3 classes of MKTU) in Lithuania, Latvia and Estonia. Your costs will be as follows:

state fee for filing an international application - 2400.00 UAH;

international filing fee to Lithuania, Latvia, Estonia - 1098.00 Swiss francs (black and white trademark);

international filing fee to Lithuania, Latvia, Estonia - 1348.00 Swiss francs (color trademark);

services for registration and filing of the international application - 2800.00 UAH.

In order to file an international application under the Madrid Agreement, registration is required in any of the countries parties to the Madrid Agreement (there must be a certificate for the identical trademark). To file an international application under the Protocol to the Madrid Agreement, an application filed is sufficient.

For filing an international application an international duty is paid in Swiss francs:

653 Swiss francs black and white TM;

903 Swiss francs colored TM;

100 francs for each class over 3;

100 francs for each country included in the application.

In addition to the above fees, there are countries that have established individual duties.

For filing the international application is paid a state fee of 2400.00 UAH.
